1. LEGAL AGREEMENT

Welcome to Sweet Pea Ink Creative. By placing an order, downloading digital goods, or engaging with our services on [www.sweetpeainkcreative.com](http://www.sweetpeainkcreative.com) ("Site"), you acknowledge that you've read, understood, and agreed to these Terms. If you disagree with any part of the Terms, do not use our Site or purchase any products. You must be at least 18 years old and legally able to enter into contracts.

These Terms govern all products and services offered via the Site, including custom branding, semi-custom templates, design kits, and related digital downloads. We may revise these Terms at any time, with changes effective immediately upon posting.

2. ORDER TERMS & ACCEPTANCE

All orders placed are considered an offer to purchase. Orders are not binding until accepted by Sweet Pea Ink Creative. Once accepted, this becomes a legally enforceable agreement. Orders are confirmed via email, and no product files will be delivered until full payment is received.

We reserve the right to reject any order at our sole discretion.

3. PRICING & PAYMENT

Prices are listed in USD and may change without notice. Payment must be made in full at time of order or according to the payment plan selected. We accept payment via Stripe and PayPal. By purchasing, you warrant that the payment information you provide is accurate and authorized.

If you're on a payment plan, you're legally obligated to complete all scheduled payments. Failure to do so may result in revoked access, a \$50 late fee after 3 days, and legal or collection action after 45 days of non-payment.

4. NO REFUNDS / DIGITAL PRODUCTS

Due to the digital nature of our products (templates, brand kits, graphics), all sales are final. There are **no refunds, returns, or exchanges.**

In exceptional cases, Sweet Pea Ink Creative may approve a refund, subject to a 20% restocking fee. Proof of download or usage nullifies any refund eligibility.

5. SEMI-CUSTOM BRANDING

Purchases of semi-custom brands are final and non-refundable. Delivery timelines may vary but typically require up to 2 weeks post-questionnaire. Revisions: One (1) revision is included. Additional edits are billed at \$100/hr.

By purchasing, you understand the final files are delivered only after full approval and payment.

6. INTELLECTUAL PROPERTY & USAGE

All design assets remain the intellectual property of Sweet Pea Ink Creative. You are granted a non-exclusive, non-transferable license to use designs for personal/business branding only. Resale, redistribution, or modification for resale is prohibited.

Font licenses are not included unless explicitly stated. You are responsible for purchasing any third-party fonts recommended.

7. LIMITATION OF LIABILITY

All digital goods and services are provided "as-is." Sweet Pea Ink Creative is not responsible for any loss, delay, or misuse of files. Our liability will never exceed the amount paid for the service or product.

We are not liable for damages due to accidents, misuse, unauthorized modifications, or events beyond our control (a.k.a. force majeure).

8. PRIVACY POLICY

We collect personal info (name, email, billing info) to fulfill your orders. This data is stored securely and never shared with third parties, except for payment processing or required by law.

You can unsubscribe from marketing emails at any time. We do not sell or share your data.

9. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of the State of Virginia. All disputes shall be resolved via binding arbitration in Loudoun County, Virginia.

You waive any right to trial by jury and agree that any legal action must be initiated within one (1) year of the claim.

10. FINAL NOTES

These Terms represent the full agreement between you and Sweet Pea Ink Creative. Any waiver must be made in writing. If any clause is deemed unenforceable, the rest shall remain in full effect.
